Global Revision

A major change to the core movement system: face, mouth, head turn, body movement, or main physics setup.
Included: 1 revision during the main setup stage.

Medium Revision

A change to separate movements: hair physics, outfit physics, expressions, eye movement, mouth shapes, or body parameters.
Included: 3 revisions during the adjustment stage.

Minor Revision

A small adjustment: movement speed, reaction strength, minor asymmetry, small physics tweaks, or tiny tracking fixes.
Included: up to 10 revisions during the final stage.

Mistakes made by the artist are fixed separately and do not count toward the revision limit.

The final price may change depending on the model complexity, layer quality, movement range, physics, expressions, props, extra body parts, or additional animation features.

The final price may change depending on the complexity of the character, outfit, accessories, pose, background, amount of detail, or the number of characters in the artwork.

These Terms of Service apply to all commission types: Arts, Splash Arts, VTuber Models, and Rigging.
By ordering a commission, the client agrees to the terms below.

1. Commission Process

The commission starts after the idea, references, scope of work, price, deadline, and payment terms are agreed upon.
The client should provide clear references, character details, style preferences, usage plans, and any important requirements before the work begins.
Major changes requested after an approved stage may be treated as additional work and may increase the final price.
The artist may decline a commission before work begins if the theme, style, deadline, or project conditions are not suitable.

2. Payment

Payment terms are agreed upon before the commission starts.
Unless discussed otherwise, the payment can be split into two parts:

• 50% before the work begins;
• 50% before the final files are delivered.

For smaller commissions, full upfront payment may be required.
The final files are delivered only after full payment.
Rush orders, extra features, additional characters, complex backgrounds, commercial usage, private commissions, or extra revisions may cost more.

3. Revisions

Each commission type includes a set number of revisions, which will be listed in the selected service details.
Revisions are divided into:

• Global Revision — a major change to the main idea, composition, design, structure, or core movement.
• Medium Revision — a noticeable change to separate parts of the artwork, model, or rig.
• Minor Revision — a small final adjustment that does not require major reworking.

Mistakes made by the artist are fixed separately and do not count toward the revision limit.
Changes requested after a stage has already been approved may be treated as additional work.

4. Deadlines

Deadlines depend on the complexity of the commission, the current queue, and the speed of client feedback.
If the client delays feedback, provides unclear instructions, or changes the scope of work, the deadline may be extended.
Rush deadlines must be discussed before the commission starts and may cost extra.

5. Delivery

Final files are delivered digitally after full payment.
The file format depends on the commission type:

• Arts and Splash Arts are delivered as final image files, usually in 4K PNG.
• VTuber Models are delivered as layered PSD model files prepared for rigging.
• Rigging is delivered as a ready-to-use Live2D model setup for VTube Studio.

The artist is not responsible for issues caused by incorrect third-party software setup, unsupported devices, outdated software, or changes made to the files after delivery.

6. Source Files

Source files are not included by default unless stated in the selected service details.
For regular Arts and Splash Arts, the PSD file is not included by default.
For VTuber Models, the layered PSD model file is included.
For Rigging, the cmo3 Live2D working file is not included by default.
Source files may not be shared, resold, redistributed, edited for resale, or passed to third parties unless permission was given in advance.

7. Usage Rights

The client may use the finished commission for the agreed purpose.
For personal and creator use, this may include:

• social media;
• profile pictures;
• banners;
• covers;
• stream assets;
• videos;
• personal branding;
• VTuber content;
• monetized streams and videos.

Commercial use for merchandise, advertising, paid products, printed goods, resale, games, apps, visual novels, agency use, company use, or large promotional campaigns must be discussed separately.
The artist keeps the authorship of the work unless a separate rights transfer agreement is made.

8. Credits

Credit to Elly Steiny is required when publishing or using the commissioned work publicly.
For VTuber Models and Rigging, credit should be placed in a visible location, such as the channel description, profile, website, debut post, or credits page.
The client may not claim the work as made by someone else.

9. Prohibited Use

The client may not use the commissioned work for:

• NFT projects;
• AI training;
• generative datasets;
• resale as an asset;
• unauthorized merchandise;
• illegal content;
• hateful or harmful content;
• misleading impersonation;
• redistribution of source files;
• claiming authorship over the artwork, model, or rig.

Any usage not discussed before the commission may require additional permission.

10. VTuber Models

VTuber Model commissions include a layered PSD model file prepared for future rigging.
The client may use the model for streaming, videos, social media, and personal creator branding.
The model file may be shared with a rigger only for the purpose of rigging the commissioned model.
The client may not resell, redistribute, give away, or reuse parts of the model as separate assets.
Additional outfits, expressions, hairstyles, props, hands, wings, tails, or other model features are priced separately.

11. Rigging

Rigging commissions require a properly prepared PSD model file.
If the model was drawn by another artist, the file must be checked before the commission starts.
The artist may decline the rigging commission if the PSD file is not suitable for rigging, has missing parts, merged layers, incorrect separation, or technical issues.
The final rig is prepared for VTube Studio unless discussed otherwise.
The cmo3 working file is not included by default.
Additional expressions, toggles, physics, props, special animations, VBridger setup, or advanced tracking features may cost extra.

12. Cancellations and Refunds

If the client cancels the commission before work begins, a refund may be possible depending on the payment stage and agreement.
If the work has already started, the refund amount depends on the completed work.
If the commission is already finished or final files have been delivered, refunds are not available.
If the artist cancels the commission for personal or technical reasons, the unfinished part of the work may be refunded.

13. Communication

The client should provide feedback clearly and on time.
If the client becomes inactive for a long period without notice, the commission may be paused.
If the client returns later, the deadline may need to be rescheduled depending on the artist’s current queue.
Rude, aggressive, or disrespectful communication may lead to cancellation of the commission.

14. Privacy and Portfolio Use

The artist may post the finished work, process previews, screenshots, model showcases, or rigging demos in a portfolio or social media.
If the commission is private, under NDA, or connected to a secret debut, this must be discussed before the commission starts.
Private commissions, delayed posting, NDA work, or full confidentiality may cost extra.

15. Changes to the Terms

These Terms of Service may be updated over time.
The terms agreed upon at the start of the commission apply to that commission, unless both sides agree to change them.
